FSSAI Licensing
Subject to Regulation 2.1.1, no person shall commence any food business unless he possesses a valid license. All Food Business Operators in the country to be registered or licensed in accordance with the procedures laid down by FSSAI 2011.

Depending on the Food Product, nature of Business and Manufacturing Capacity, we select the right Food category/ies of the License to be filed.

Filing License is not merely uploading the requisite documents, it is your first step to a successful venture. You have invested lot of your time, effort and finances in the Business, it is unwise to compromise on the License part. An incomplete application or choosing irrelevant Food categories can jeopardize your business, besides raking regulatory and compliance issues.

Compliance and Validation
A good label is one which grabs attention of the customer with its brands name, design and description of the contents. On the flip side, a wrongly designed label may draw flak from enforcement officers of FDA in its first impression, leading to stringent investigation and subsequently attracting Courts summon and penalties.
The packaging and labeling requirements shall comply with the FSS (Packaging and Labeling) guidelines 2011 and any amendments released thereof. Besides the branding part, a label must display the regulatory and compliance statements as mandated by FSSAI:

The manufacturer’s or distributor’s and/or marketers name and address

FSSAI License of manufacturer and marketer.

The weight of the product

Active and inactive ingredients (listed according to amount, from highest to lowest)

Number of servings per product, and serving size

Nutritional values: (Calories, Total fat, cholesterol, sodium, protein, carbohydrates, sugar etc.)

FSSAI has laid down specific guidelines on:

False advertising and misleading claims (The FSSAI has notified the regulations on advertising and claims and these will be called the Food Safety and Standards (Advertising and Claims) Regulations, 2018.

Warning for high salt, sugar or fat content

Labeling requirements of pre-packaged foods and display of essential information on premises where food is manufactured, processed, served and stored. The FSSAI has proposed new regulations to be called the Food Safety and Standards (Labelling and Display) Regulations, 2018.

With amendments and modifications coming up regularly, we understand FBO's are per-occupied in other management issues, are unable to update themselves on daily basis. We offer consultancy services and regular updates on all Regulations of FSSAI to all our clients.

Any non-compliance will attract financial penalty to the tune of Rs. 5 Lakhs and/or imprisonment as per the Act.
Food Safety Management System (FSMS)
As per FSSAI all FBO's need to implementation FSMS. In pursuance to Part III, Section 8(1) of Food Safety and Standards (Food Safety Auditing) Regulations 2018, food business holding Central License shall be subject to regular mandatory food safety auditing.

Definition of FSMS As per FSSAI

A Food Safety Management System (FSMS) is a network of interrelated elements that combine to ensure that food does not cause adverse human health effects. These elements include programs, plans, policies, procedures, practices, processes, goals, objectives, methods, controls, roles, responsibilities, relationships, documents, records, and resources.

This begins with Initial Status Gap Analysis, using the checklist to ascertain how far the present system and practices, existing procedures and documents meet the requirements of the standard being followed.
Basis the Gap analysis, we derive the estimation of the work with time frame to be done further.
Third Party Audits
To strengthen the food safety surveillance system, FSSAI has envisaged mandatory annual audits of Food Business Operators through Private Auditing Agencies.

Nutraceutical category is under High risk categories of food business. FSSAI has empanelled about 30 Auditing agencies across India. FBO can select any one of these agencies to audit.
After the audit's completion, the auditor shall inform the Food Business Operator of the deficiencies or the non-conformities observed during the audit and give an opportunity to provide any further information or clarification required for completion of audit finding and reflect the same in the audit report. The Auditor will submit the report on FOSCOS portal within 15 days of the audit.
TPA is mandatory for FBO like Manufacturer, Relabeller and Re-packer.
In case TPA is not undertaken, FSSAI may issue a show cause/improvement notice to the FBO.
We arrange for TPA and provide necessary SOP and document formats as per Audit requirements.
Annual Reporting and Testing
FSSAI Annual Return to be submitted by FBO’s for business done in last financial year.

Eligible FBOs: Manufacturers [including Repacker and Relabeller], Importer and Manufacturer-Exporter

Last Date without penalty: 31st May every year
-
Acceptable Mode of Submission: Online through FoSCoS only
-
Penalty for non-submission: Rs. 100 per day wef 1st June
-
Maximum Penalty: 5 times the Annual License Fee
Six Monthly test Report:
All FBO’s to ensure testing of relevant chemical and/or microbiological contaminants in food products through own or NBAL accredited/FSSAI notified labs at atleast once in six months. Further provided that the gap between two mandatory testing of the same food product shall not be less than 3 months.

For April-September biannual, last date to submit text reports is 31st October.
​
For October-March biannual, last date to submit test reports is 30th April.
